Their capture technology is capturing a significant amount of oil, thus to say it is working is a simple statement of fact. The amount they are capturing is increasing, and that is very welcome progress. If you wish to take a 'glass half empty' attitude about the whole thing, that is of course your choice.

If you had a window that let in half the rain, would you consider it a window that "works"?

That is not much of an analogy. You see it as all or nothing. I see it as BP's technology to capture some of the oil working as designed, and working better as time goes on. Before, *none* of the oil was being captured.
There is an old saying among engineers; "The perfect is the enemy of the good." Under these incredibly difficult circumstances, things are getting done and it is helping. Of course, if you have a better solution, I am quite sure we all would be very interested in hearing about it.

Have you noticed how much oil they are "flaring off?"
Thousands of barrels a day are going up in smoke, not to mention the tens of millions of cubic feet of natural gas daily.
Their collection techniques may be bringing more oil to the surface (outside the leak process) but so much of it is going to waste..,
I suppose they are happy just to not be having to pay fines on every barrel they bring "up" to the surface.

BP's shares, meanwhile, fell after a U.S. lawmaker released an internal company document on Sunday pegging the worst-case scenario rate for the spill far higher than the government figures. The oil giant's stock, nearly halved in value since the crisis began, slid more than 2 percent in London and New York trading after the document estimated a rate of 100,000 barrels per day.
BP spokesman Toby Odone said the document appeared to be genuine but the estimate applied only to a situation in which a key piece of equipment called a blowout preventer is removed.
